App Terms of Service & Subscription Terms

2. Scope and Acceptance

These App Terms apply to:

• The SHFT mobile application (iOS and Android)
• App-based features, content, and services
• Paid subscriptions and free trials

Purchase and use of SHFT physical products are governed by separate Website & Hardware Terms and Conditions.

3. Eligibility

You must be at least 13 years old to use the App.

If you are under 18, you represent that you have permission from a parent or legal guardian to use the App.

4. App Functionality

The App provides fitness and wellness features, including performance insights, coaching guidance, and activity analytics.

Certain features of the App require:

• Use of SHFT running Pods, and/or
• Integration with compatible smartwatch applications, where supported

The App and related insights are provided for fitness and wellness purposes only.

The App is not a medical device and is not intended for diagnosis, treatment, or prevention of any medical condition.

5. Account Registration

To access certain features, you may be required to create an account.

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity conducted through your account

6. Subscriptions, Free Trials, and Billing

6.1 Free Trial

SHFT offers a 90-day free trial for eligible new users.

Unless cancelled before the end of the free trial period, your subscription will automatically convert to a paid subscription.

6.2 Subscription Plans

Subscription options may include:

• Monthly subscriptions
• Annual subscriptions

Pricing and available plans are displayed in the App at the time of purchase.

6.3 Billing and Payment

All subscription payments are:

• Processed by Apple App Store (iOS) or Google Play (Android)
• Charged to your App Store or Google Play account

SHFT does not process subscription payments directly and does not store payment card details.

6.4 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

7. Cancellation and Refunds

7.1 Cancellation

You may cancel your subscription at any time via:

• Your Apple App Store account settings, or
• Your Google Play account settings

Deleting the App does not cancel your subscription.

7.2 Refunds

Refund requests for subscriptions are handled exclusively by Apple or Google, in accordance with their respective policies.

SHFT cannot issue or process subscription refunds on behalf of Apple or Google.

8. License Grant

Subject to these App Terms, SHFT grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial purposes.

9. Acceptable Use

You agree not to:

• Misuse or interfere with the App
• Reverse engineer or attempt to extract source code
• Use the App for unlawful purposes
• Circumvent security or subscription mechanisms

10. Intellectual Property

All intellectual property rights in the App, including software, content, trademarks, and branding, are owned by SHFT or its licensors.

No rights are granted except as expressly stated in these App Terms.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the App is provided "as is" and "as available".

SHFT does not warrant that the App will be uninterrupted, error-free, or meet your expectations.

12. Limitation of Liability

To the maximum extent permitted by law:

• SHFT shall not be liable for indirect, incidental, or consequential damages
• SHFT's total liability arising from use of the App shall not exceed the amount paid by you for the subscription during the 12 months preceding the claim

Nothing in these App Terms limits liability where such limitation is prohibited by law.

13. Termination

SHFT may suspend or terminate access to the App if you materially breach these App Terms.

You may stop using the App at any time by cancelling your subscription and deleting the App.

14. Apple and Google Platform Terms

14.1 Apple App Store

If you downloaded the App from Apple's App Store:

• Apple is not a party to these App Terms
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for any claims related to the App

14.2 Google Play

If you downloaded the App from Google Play, Google is not responsible for the App or its content.

15. Governing Law

These App Terms are governed by the laws of Denmark, without prejudice to mandatory consumer protection laws applicable in your country of residence.

16. Changes to These App Terms

SHFT may update these App Terms from time to time.

Updated App Terms will be made available in the App or on the SHFT website with a revised "Last updated" date.
